Is this a HIPAA Violation?
There are now an increasing number of lawsuits over HIPAA-related issues. In this example, two cardiac surgeons are fined by the U.S. Department of Health and Human Services Office for Civil Rights for HIPAA violations. A complaint was filed alleging that the surgeons disclosed electronic protected health information by making it publicly available on the internet. The physicians were required to pay a $100,000 fine and adopt a Corrective Action Plan that included seven recommendations that you, as a physician, should be aware of.

Who gets sued: Managed care or me?
Because of a delay in treatment due to a healthcare plan's request for medical records, a patient suffers metastases to the local lymph nodes. The patient files a lawsuit against the physician and healthcare plan. The state court throws out the case against the plan and lets the lawsuit proceed against Dr. Dave. Dr. Dave asks, "Why me?"

Diagnostic errors lead to malpractice claims
Diagnostic errors account for the greatest proportion of total payments on malpractice claims in the past 25 years, a study indicates. Analyzing 350,706 paid malpractice claims from the National Practitioner Bank from 1986 to 2010, investigators with Johns Hopkins University School of Medicine described the error type, outcome severity and payments. Diagnostic errors accounted for 28.6 percent of all paid claims, and had the highest proportion of total payments, at 35.2 percent.
